Chapter 1 General Provisions Article 1 In order to promote the development of urban landscaping, strengthen ecological environmental protection, improve the living environment, and enhance people's physical and mental health, in accordance with the "Urban and Rural Planning Law of the People's Republic of China" The "Urban Greening Regulations" and other relevant laws and administrative regulations are formulated based on the actual conditions of this city. Article 2 These regulations shall apply to the planning, construction, protection and management of urban landscaping within the urban planning areas and town planning areas of this city. Article 3 Urban landscaping should adhere to the principles of people-oriented, ecological priority, scientific planning, adapting measures to local conditions, and paying equal attention to construction and management. Article 4 The municipal, district and county (autonomous county) people's governments shall strengthen leadership over urban landscaping work, incorporate urban landscaping into national economic and social development plans, and ensure funding investment in urban landscaping.
Encourage urban garden creation activities and promote the healthy development of urban landscaping.
Encourage units and individuals to participate in the construction and management of urban landscaping in the form of investment, donation, construction, adoption, management, etc. Article 5 The municipal department in charge of urban landscaping is responsible for the management of urban landscaping in the city.
The urban landscaping administrative departments of districts and counties (autonomous counties) are responsible for the management of urban landscaping within their own administrative regions.
Planning natural resources, housing and urban-rural construction, transportation, water conservancy and other relevant departments shall do a good job in the management of urban landscaping according to their respective responsibilities.
The town people's government and sub-district offices shall carry out urban landscaping work within their respective jurisdictions according to their responsibilities. Article 6 The competent department of urban landscaping shall carry out, organize and guide the scientific research and transformation of urban landscaping results, formulate plans every year to increase high-quality plant varieties, promote advanced technologies and materials, strengthen biodiversity protection, and improve the level of urban landscaping. Article 7 The urban landscaping administrative department shall study and formulate industrial policies, prepare urban nursery industry development plans, and organize and guide the production of landscaping seedlings. Article 8: Any unit or individual has the right to enjoy a good urban landscaping environment, has the obligation to protect urban landscaping and facilities, and has the right to dissuade, complain and report any behavior that damages urban landscaping and facilities. Chapter 2 Planning and Construction Article 9 The urban greening plan shall be jointly prepared by the municipal people's government, organized by the municipal urban landscaping department and the municipal planning and natural resources department, and shall be incorporated into the land and space planning.
Urban greening planning should reasonably arrange the urban greening land area that is commensurate with the urban population and urban area according to the needs of urban development. Planning indicators such as per capita public green space area and green coverage rate should comply with relevant national regulations. Article 10 The urban landscaping department shall prepare an urban green space system plan based on the approved land spatial planning and urban greening plan. The urban landscaping department shall hand over the contents involving planned land and spatial layout to the planning and natural resources department for comprehensive balance.
The urban green space system planning of the main urban area shall be organized and compiled by the municipal urban landscaping department and submitted to the Municipal People's Government for approval.
The district and county (autonomous county) urban green space system planning is organized and compiled by the district and county (autonomous county) urban landscaping department. After soliciting the opinions of the city's urban landscaping department, it is submitted to the district and county (autonomous county) people's government for approval. .
The approved urban green space system plan should be strictly implemented; if changes are really needed, they should be made in accordance with legal procedures. The total amount of green space after the change must not be reduced, the system must not be destroyed, and the functionality must not be reduced.
Urban landscaping authorities shall prepare annual urban landscaping construction plans based on urban green space system planning and organize their implementation. Article 11 The urban landscaping department and the planning and natural resources department shall prepare urban greenway planning and mountain trail planning, organically integrate ecology, culture, transportation and other elements, and use trails to connect urban and rural green resources and historical context. Article 12 The planning natural resources department and the urban landscaping department shall be responsible for the delineation, supervision and management of urban green lines in accordance with the division of responsibilities.
Urban green lines are divided into current green lines, planned green lines and ecological control lines. The current green lines and planned green lines should be delineated hierarchically at each stage of territorial spatial planning, and the ecological control lines should be delineated at the overall territorial spatial planning stage.
Park green space, protective green space, production green space, surrounding ecological control areas outside the blue line of mountains in the city, rivers, lakes, and reservoirs, scenic spots, etc., have an important impact on the quality of the urban ecological environment, residents' leisure life, and biodiversity. To protect green spaces that have a direct impact, urban green lines should be delineated.
The delineated urban green lines should be strictly implemented, announced to the public in a timely manner, and accepted to social supervision. Article 13 The municipal urban landscaping department shall, in conjunction with the municipal planning and natural resources department, determine the permanently protected green space, announce it to the public, and set up a notice board at a conspicuous location of the permanently protected green space. Article 14 Urban ecological parks should be determined as permanently protected green spaces and be constructed and managed in accordance with park green spaces. The land used for supporting management and service facilities should be included in the construction land quota. When the project is implemented, its land use quota should be within the scope of the administrative district, etc. Quantity replacement balance.
Article 15 New construction projects shall construct attached green spaces in accordance with regulations, and the green space rate shall meet the following requirements:
(1) Residential projects shall not be less than 30%, and urban renewal residential projects that are demolished and rebuilt shall not be less than 30%. Less than 25%;
(2) Public management and public service facilities shall not be less than 35%;
( 3) No less than 25% for business facilities projects, and no less than 10% for commercial facilities projects;
(4) No less than 20% for road and transportation facilities projects;
(5) The green space rate of other types of construction projects shall comply with relevant national and municipal regulations.
If the green space rate cannot meet the provisions of the preceding paragraph and needs to be adjusted due to land use conditions, the particularity of the construction project, etc., before the transfer of the construction land use rights, the planning and natural resources department shall work together with the urban landscaping and greening department to make a special decision. After demonstration, the main urban area shall be approved by the Municipal People's Government, and other areas shall be approved by the people's government of the district or county (autonomous county) where it is located.
